The opportunity is also being taken to amend

Clause XIV of the Royal Instructions so as to permit of

a provisional appointment being made by the Governor to

the Legislative Council whenever an unofficial member is

acting in a post the holder of which is an ex-officio

member. The existing Instructions only provide for this

being done where an official member is so acting, but the

other contingency occurs occasionally, e.g. it was recently

desired to appoint an unofficial in place of Sir H. Pollock,

who was acting as Attorney-General.

A paragraph has also been added to Clause XIII to

provide that if any Official Member of the Legislative

Council ceases to hold office in the Colony his seat in

the Council shall become vacant. At present the position

is rather obscure when an official member either retires or

is transferred to another Colony and fails to resign his
